Terms of Use

These Terms of Use ("Terms") govern your use of Topo360, including the Topo360 mobile applications and topo360.fit website. Topo360 is developed and operated by SummitFlow LLC ("SummitFlow," "we," "us," or "our"). By using Topo360, you agree to these Terms.

1. Purpose of Topo360

Topo360 provides interactive 360° climbing route previews and related information intended to help climbers understand terrain, pitches, belays, anchors, approaches, rappels, and other route features. Certain route content may be available for offline use. Topo360 is an informational and planning aid. It is not a substitute for appropriate climbing experience, judgment, training, guidebooks, local knowledge, professional instruction, or assessment of actual conditions.

2. Climbing Is Inherently Dangerous

Rock climbing, mountaineering, rappelling, hiking, and related outdoor activities involve serious risks, including severe injury and death. Conditions can change, hardware can fail, routes can be altered, information can become outdated, and images can omit hazards. You are solely responsible for evaluating the route, weather, rock quality, anchors, protection, access, descent, your equipment, your abilities, and the abilities of your partners. Do not rely on Topo360 as your sole source of climbing or safety information.

3. Accuracy and Availability

We try to provide useful route information, but we do not guarantee that any topo, panorama, route line, pitch description, grade, anchor location, rappel information, map, GPS position, access information, or other content is complete, current, or accurate. Topo360 may be unavailable, interrupted, changed, or discontinued. Offline availability depends on successful downloads, device storage, compatible software, and other factors outside our control.

4. Offline Use

Downloading a route does not guarantee that all information required for a climb will be available offline or remain accessible on your device. Before entering an area without service, verify that needed content has downloaded correctly and carry appropriate independent navigation and route information.

5. Acceptable Use

You may use Topo360 for personal, lawful climbing and trip-planning purposes. You may not misuse the service, attempt unauthorized access, interfere with its operation, circumvent technical protections, scrape or systematically copy content, or reproduce or redistribute Topo360 content except as permitted by law or with written permission.

6. Intellectual Property

Topo360, its software, branding, interface, 360° imagery, original route presentation, graphics, and other original content are owned by SummitFlow LLC or used with permission and are protected by applicable intellectual-property laws. Names, route information, maps, photographs, or other material supplied by third parties may remain the property of their respective owners.

7. onBelay and Third-Party Services

Topo360 may link to onBelay, another SummitFlow product, for online route previews or related climbing content. onBelay is a separate service and may have its own terms and privacy policy. Topo360 may also link to third-party websites, climbing resources, maps, app stores, or other services. SummitFlow does not control and is not responsible for third-party content, availability, practices, or terms.

8. App Stores and Platforms

If you obtain Topo360 through Apple, Google, or another distribution platform, your use may also be subject to that platform's applicable terms. Those platform terms apply in addition to these Terms where relevant.

9. Disclaimer of Warranties

To the fullest extent permitted by law, Topo360 is provided "as is" and "as available," without warranties of any kind, express or implied. SummitFlow does not warrant that Topo360 will be uninterrupted, error-free, accurate, complete, suitable for a particular climb, or available in every location or on every device.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SummitFlow LLC and its owners, contributors, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for injuries, losses, or damages arising from reliance on route information, participation in climbing activities, loss of connectivity, device failure, or use of or inability to use Topo360. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

11. Changes to Topo360 or These Terms

We may modify Topo360 and may update these Terms from time to time. Updated Terms will be posted on topo360.fit with a revised effective date. Continued use after an update constitutes acceptance of the revised Terms to the extent permitted by law.

12. Governing Law

These Terms are governed by the laws applicable to SummitFlow LLC, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.
